Discretionary Trusts

This form of trust is the most common and is often used as a family trust for tax effective income distribution and asset protection. A trust is not a legal entity but rather a relationship between the trustee and the beneficiaries of the trust which is conducted in accordance with the terms set out in the trust deed.

The trustee can be a person or a company. The trustee holds the trust property on behalf of the beneficiaries. The trustee must act in good faith for the benefit of the beneficiaries of the trust.

You should seek your accountant's advice as to whether your affairs would benefit from establishing a discretionary trust.
