Custodian Agreements for SMSF's
Over the past months we have worked with Greg Vale of BinetterVale Lawyers to develop Custodian Deed and Loan Agreement packages for those SMSF's which want to take advantage of the Instalment Warrant Arrangements at competitive prices.
To assist you and your clients we have created 3 packages.
Package No 1 - Custodian Deed Only
The Custodian Deed sets out the arrangements between the trustee
of the SMSF and the custodian, the legal owner of the property
purchased under the instalment warrant loan.
The Deed can be used for arrangements utilising both third party
loan funds and related party loan funds.
The terms of the Deed have been approved by lawyers acting for
the major lenders in this area.
The package includes:
- The Custodian Deed
- Minutes of the Trustee of the SMSF
- Minutes of the Custodian
- A comprehensive information memorandum drafted by BinetterVale Lawyers setting out the necessary steps in the transaction
This package is priced at $440.00.
Package No 2 - Custodian Deed & Loan Agreement
The Loan Agreement can be used when the SMSF resolves to borrow from a related party.
The Loan Agreement regulates the loan to the trustee of the SMSF and its security in the property.
The package includes:
- The Custodian Deed
- The Loan Agreement
- Minutes of the Trustee of the SMSF
- Minutes of the Custodian
- Minutes of the Lender and any corporate Guarantors
- A comprehensive information memorandum drafted by BinetterVale Lawyers setting out the necessary steps in the transaction.
This package is priced at $880.00.
Package No 3 - The Full Instalment Warrant Package
This package includes all the documents in Package No 2 and
- A SMSF establishment or upgrade; and
- An incorporation of the sole-purpose Custodian
This package is priced at $1,760.00 (inclusive of ASIC fee).

Reminder about names for officeholders and members
ASIC does not accept abbreviated or preferred names. The use of them can also cause a duplicate record on the ASIC register. As the ASIC compliance checks are starting to increase in frequency it is advisable to ensure that your clients provide you with their full legal names.
